SnailMailHQ Digital Millennium Copyright Act (DMCA) & Copyright Policy

Effective Date: November 2, 2026

SnailMailHQ (operated by Gingiber LLC) provides software and hosting services that enable independent creators ("Creators") to showcase and operate subscription mail clubs. We respect the intellectual property rights of creators and copyright owners and comply with the safe harbor provisions of the Digital Millennium Copyright Act, 17 U.S.C. § 512 et seq. ("DMCA").

1. Scope of Policy: Digital Media vs. Physical Goods

Digital Media Hosted on Platform: This Policy governs digital content, promotional previews, images, listing graphics, text, and artwork hosted directly on snailmailhq.com.

Physical Shipped Goods: Physical merchandise, prints, stickers, letters, and paper goods produced and shipped through the mail by Creators are physical goods governed by UCC Article 2 and our Creator Agreement. The DMCA Safe Harbor applies solely to online, digital content hosted on the Platform. Inquiries regarding physical mailings must be directed to the Creator as the direct retailer or submitted to platform compliance support.

2. Procedure for Reporting Copyright Infringement (Takedown Notices)

If you believe in good faith that any digital content or artwork preview hosted on snailmailhq.com infringes your copyright, you (or your authorized agent) may submit a written DMCA Takedown Notice to our Designated Copyright Agent.

To be effective under 17 U.S.C. § 512(c)(3), your Takedown Notice must be in writing and contain the following statutory elements:

Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed;

Identification of Work: Identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works);

Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled, including the specific web URL(s) or exact location on snailmailhq.com;

Contact Information: Information reasonably sufficient to permit us to contact you, including your full legal name, physical address, telephone number, and email address;

Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law (including Fair Use); and

Perjury & Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Takedown Processing and Creator Notification

Upon receipt of a statutory notice meeting all six requirements above, SnailMailHQ will:

Expeditiously remove or disable access to the allegedly infringing digital material hosted on the Site; and

Promptly take reasonable steps to notify the affected Creator that access to the material has been removed or disabled, providing a copy of the Takedown Notice.

4. Counter-Notification Procedure for Creators

If a Creator believes in good faith that digital material removed or disabled as a result of a DMCA Takedown Notice was removed due to mistake, misidentification, or authorization, the Creator may submit a written Counter-Notification to our Designated Copyright Agent under 17 U.S.C. § 512(g)(3).

To be effective, a Counter-Notification must be in writing and contain the following elements:

Signature: A physical or electronic signature of the Creator;

Identification of Material: Identification of the material that has been removed or to which access has been disabled, and the specific URL or location at which the material appeared before it was removed or disabled;

Perjury Statement: A statement under penalty of perjury that the Creator has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and

Contact Information & Consent to Jurisdiction: The Creator's full legal name, physical address, telephone number, and email address, along with a statement that the Creator consents to the jurisdiction of the Federal District Court for the judicial district in which the Creator's physical address is located (or if the Creator's address is outside the United States, for any judicial district in which SnailMailHQ may be found), and that the Creator will accept service of process from the person who provided the original Takedown Notice or an agent of such person.

5. Material Restoration Protocol

Upon receiving a valid, statutorily compliant Counter-Notification, SnailMailHQ will promptly forward a copy to the original complaining party. Under 17 U.S.C. § 512(g)(2)(C), SnailMailHQ will restore or re-enable access to the removed material not less than ten (10) nor more than fourteen (14) business days following receipt of the Counter-Notification, unless our Designated Copyright Agent receives official notice from the complaining party that they have filed an action in a court of competent jurisdiction seeking a court order to restrain the Creator from engaging in infringing activity relating to the material on the Site.

6. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i)(1)(A), SnailMailHQ maintains a strict policy to terminate, in appropriate circumstances and at our sole discretion, the accounts of Creators or users who are determined to be repeat infringers. A Creator may be deemed a repeat infringer if they receive multiple formal DMCA Takedown Notices that are not successfully contested through valid Counter-Notifications, or if their account exhibits repeated instances of unauthorized copyright usage. SnailMailHQ reserves the right to suspend or terminate accounts immediately upon a single egregious copyright violation.

7. Misrepresentation Warning (17 U.S.C. § 512(f))

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to substantial liability. This includes civil money damages, court costs, and attorneys' fees incurred by SnailMailHQ, any copyright owner, or any Creator who is injured as a result of relying upon such misrepresentation.
